Privacy Policy

This Privacy Policy ("Policy") describes how Pure Dog Talk, Inc., a corporation organized under the laws of the State of Oregon ("Pure Dog Talk," "we," "us," or "our"), collects, uses, discloses, retains, and protects Personal Information in connection with puredogtalk.com, the Pure Dog Talk podcast, our membership platforms, our seminars and events, the Club Partner Program, our shop, and all related products, services, and communications (collectively, the "Services").

This Policy applies to information collected through the Services and supplements, but does not replace, our Terms of Service. Capitalized terms not defined herein have the meanings given in the Terms of Service.

By accessing or using the Services, you acknowledge that you have read and understood this Policy. If you do not agree to the terms of this Policy, you must not access or use the Services.

Section headings are provided for convenience only and shall not affect the interpretation of this Policy.

Scope and Applicability

This Policy applies to all individuals who interact with the Services, including without limitation: visitors to our public website; registered Free Members; paid Patrons; Club Partner Program participants and Submitting Officers; Seminar attendees; podcast guests; recipients of our communications; and customers of our shop.

Different sections of this Policy may apply to different categories of individuals depending on the nature of the interaction. Certain features of the Services, including the Member directory, courses, community features, and Member-to-Member communication, are available only to authenticated Members and are gated behind a password-protected paywall managed by MemberPress.

This Policy does not apply to information collected by third parties whose websites, applications, or services may be linked to or integrated with the Services. We encourage you to review the privacy policies of those third parties.

Key Definitions

For purposes of this Policy:

  • "Personal Information" or "Personal Data" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to a particular individual or household.
  • "Sensitive Personal Information" has the meaning given under the California Privacy Rights Act ("CPRA") and includes, where applicable, account login credentials in combination with passwords, precise geolocation, racial or ethnic origin, religious beliefs, biometric information, health information, and similar categories.
  • "Process" or "Processing" means any operation or set of operations performed on Personal Information, including without limitation collection, recording, organization, structuring, storage, adaptation, retrieval, consultation, use, disclosure, dissemination, alignment, restriction, erasure, or destruction.
  • "Member" means an individual with a registered Free or paid Patron Account on the Services.
  • "Member Area" means the password-protected portion of the Services available only to authenticated Members, including without limitation the Member dashboard, profile, directory, courses, community, and similar features.
  • "Service Provider" means any third party that Processes Personal Information on behalf of Pure Dog Talk for a defined business purpose pursuant to a written contract that prohibits the Service Provider from (i) selling or sharing the Personal Information; (ii) retaining, using, or disclosing the Personal Information for any purpose other than the specific business purpose; (iii) retaining, using, or disclosing the Personal Information outside of the direct business relationship; and (iv) combining the Personal Information with Personal Information received from other sources, except as expressly permitted by applicable law.
  • "Sale" and "Sharing" have the meanings given under the California Consumer Privacy Act ("CCPA") and CPRA. "Sharing" specifically includes the disclosure of Personal Information to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.
  • "Cross-Context Behavioral Advertising" means the targeting of advertising to a consumer based on the consumer's Personal Information obtained from the consumer's activity across businesses, distinctly-branded websites, applications, or services, other than the business, distinctly-branded website, application, or service with which the consumer intentionally interacts.
  • "Consumer," "Data Subject," or "Individual" means any individual whose Personal Information is Processed by Pure Dog Talk.

Notice at Collection

In compliance with California Civil Code §1798.100(b), Pure Dog Talk provides notice at or before the point of collection of Personal Information. The categories of Personal Information collected, the purposes for which Personal Information is collected, and the retention periods are set forth in this Policy. Notices at the point of collection (such as on signup forms, checkout pages, and registration forms) reference and link to this Policy.

Pure Dog Talk shall not collect categories of Personal Information other than those disclosed in this Policy without first providing notice to you in compliance with applicable law.

Categories of Personal Information We Collect

Within the twelve (12) months preceding the Effective Date of this Policy, Pure Dog Talk has collected, and may continue to collect, the following categories of Personal Information as defined under the CCPA and CPRA:

Identifiers

Name, email address, postal address, telephone number, Account username, IP address, device identifiers, social media handles voluntarily submitted to your Member profile, and similar identifiers.

Account and Authentication Data

Login credentials (encrypted), session tokens, login timestamps, IP addresses associated with logins, password reset events, and Account security information.

Customer Records

Information you provide when registering for an Account, registering for a Seminar, submitting a Club Partner Application, booking a consultation, or making a purchase, including billing address and payment-related information processed by our payment processor.

Member Profile Data

Information you voluntarily contribute to your Member directory profile, including kennel name, breeds of interest, general location, biographical details, years of breeding experience, club memberships, and links to social media accounts. Member profile data is visible only to other authenticated Members within the Member Area.

Commercial Information

Records of products, courses, or services purchased, obtained, or considered, including subscription tier, transaction history, course enrollment, course progress, certificates earned, digital badges issued, and discounts redeemed.

Internet or Network Activity

Browsing history, search history, and information regarding your interaction with the Services, including pages viewed, time spent, articles read, podcasts listened to (where listening occurs through our first-party platform), videos viewed, and referring URL.

Geolocation Data

General geographic location derived from your IP address. Where you voluntarily submit a postal address (for shipping, event registration, or directory profile location), that information is also Processed for the relevant purpose. We do not collect precise geolocation data through automated tracking.

Audio, Visual, and Similar Information

Voice recordings (when you appear as a podcast guest), video and photographic recordings (when you attend a Seminar that includes filming), and photographs you submit through forms, profile uploads, or testimonial submissions.

Professional or Employment Information

Information about your role, organization, or affiliation, particularly in connection with the Club Partner Program (including officer role, club name, and club website).

Member Activity Data

Engagement within Member-only features, including community posts, comments, messages to other Members (where such functionality is offered), event RSVPs, course completions, and similar activity records.

Inferences

Inferences drawn from the categories above, such as content topic preferences and engagement levels, used solely to operate and improve the Services. We do not use inferences to make decisions that produce legal or similarly significant effects.

Sensitive Personal Information

Account login credentials in combination with passwords, used solely to authenticate access to the Services. We do not knowingly collect other categories of Sensitive Personal Information.

Data Minimization

Pure Dog Talk is committed to collecting only the Personal Information reasonably necessary to operate the Services, fulfill our contractual obligations, and comply with applicable law. We do not collect categories of Personal Information that are not reasonably required for the purposes described in Section 6.

Data Accuracy

We take reasonable steps to maintain the accuracy of Personal Information we Process. You have the right to correct inaccurate Personal Information as set forth in Section 14.

Annual Review

This Policy is reviewed and updated at least annually to reflect current data practices and applicable law.

Sources of Personal Information

We collect Personal Information from the following sources:

  1. Directly from you when you register an Account, complete a directory profile, submit a form, register for a Seminar, submit a Club Partner Application, book a consultation, make a purchase, contact us, subscribe to a newsletter, submit a testimonial, post in the Member community, or appear as a podcast guest;
  2. Automatically through your interaction with the Services, including IP address, device information, browser type, and usage data collected via cookies, web beacons, and similar technologies;
  3. From our Service Providers, including our payment processor, membership platform, email service provider, scheduling provider, and analytics providers, as set forth in Section 10;
  4. From third parties such as social media platforms, podcast distribution services, and partner organizations, where you have authorized those third parties to share information with us, or where such third parties have provided your Personal Information in the ordinary course of business (for example, a podcast guest referred by a third party).

Indirect Collection Notice (GDPR Article 14)

Where we obtain Personal Information from a source other than the Data Subject, we shall provide the Data Subject with the information required by Article 14 of the GDPR within a reasonable period after obtaining the data and at the latest within one (1) month, unless an exception under Article 14(5) applies.

Consequences of Failure to Provide Personal Information

Where the provision of Personal Information is required by statute, contract, or as a condition of receiving the Services (for example, name and email address are required to register an Account), failure to provide such Personal Information may result in our inability to provide the Service. Where the provision of Personal Information is voluntary (for example, completing a Member directory profile), failure to provide such information has no consequences other than the inability to use the related feature.

Purposes of Processing and Legal Bases

We Process Personal Information for the following business and commercial purposes. For individuals located in the European Economic Area, the United Kingdom, or other jurisdictions requiring identification of a legal basis under the GDPR or equivalent law, the legal bases are identified parenthetically below.

Account Creation, Authentication, and Subscription Management

To create and manage your Account, authenticate Member access to the Member Area, process Subscription registrations and renewals, and deliver Member benefits. (Legal basis: performance of a contract.)

Member Directory and Community Features

To make your voluntarily submitted directory profile information available to other authenticated Members within the Member Area, to facilitate Member-to-Member discovery, and to operate community features. (Legal bases: performance of a contract; consent.)

Payment Processing

To process payments, prevent fraud, and maintain financial records. (Legal bases: performance of a contract; compliance with legal obligations; legitimate interest in fraud prevention.)

Service Delivery

To provide the Services you request, including Seminar registration confirmation, Club Partner Program onboarding, course delivery, badge issuance, podcast and video access, and shop fulfillment. (Legal basis: performance of a contract.)

Transactional Communication

To send communications regarding your Account, purchases, registrations, partnerships, course progress, badge issuance, booking confirmations, and to respond to inquiries. (Legal bases: performance of a contract; legitimate interest in operating the Services.)

Marketing

To send marketing emails, newsletters, and promotional communications regarding new podcast episodes, events, products, and program updates. For Users in the European Economic Area, the United Kingdom, and other jurisdictions requiring opt-in consent for marketing communications, marketing is conducted only with affirmative opt-in consent. For Users in jurisdictions permitting opt-out marketing (such as the United States under the CAN-SPAM Act), marketing is conducted with the right to opt out at any time. (Legal bases: consent; legitimate interest where permitted by applicable law.)

Analytics and Service Improvement

To understand how Members and visitors use the Services, measure performance, and improve user experience. (Legal basis: legitimate interest in operating and improving the Services; consent where required, including for non-essential cookies in the European Economic Area and the United Kingdom.)

Content Production and Distribution

To produce and distribute podcast episodes, videos, articles, and other Content, including content featuring podcast guests, Seminar attendees, and Club Partners. (Legal bases: performance of a contract; consent; legitimate interest in operating the Services.)

Legal Compliance

To comply with applicable laws, respond to legal process, prevent harm, and enforce our agreements. (Legal bases: compliance with legal obligations; legitimate interest in protecting our rights and the rights of others.)

Security and Fraud Prevention

To protect the security of the Services, detect and prevent fraud, monitor for unauthorized access, and investigate violations of our Terms of Service. (Legal basis: legitimate interest in maintaining the security and integrity of the Services.)

Profiling

We do not engage in profiling that produces legal effects concerning Data Subjects or similarly significantly affects them. We may use limited inference-based personalization (such as content recommendation based on engagement) which does not produce legal effects. (Legal basis: legitimate interest.)

Member Directory and Visibility to Other Members

The Services include a private, password-protected Member directory available only to authenticated Members within the Member Area. The directory is not accessible to anonymous visitors, search engines, or non-Members, and is not indexed for public search.

Information You Voluntarily Submit

When you complete or update your directory profile, you may voluntarily submit the following information, which becomes visible to other authenticated Members within the Member Area:

  1. Name and kennel name;
  2. Breeds of interest;
  3. General location (such as city, state, or region);
  4. Biographical "About Me" description;
  5. Years of breeding or related experience;
  6. Club memberships and affiliations;
  7. Social media handles or links you choose to provide.

Voluntary Submission and Control

Submission of directory profile information is entirely voluntary. You may complete some, all, or none of the directory profile fields. You may edit, suppress, or remove your directory profile information at any time through your account dashboard at puredogtalk.com/account/. We encourage Members to submit only the information they are comfortable sharing with other Members.

Member-to-Member Disclosure

By voluntarily submitting information to your directory profile, you authorize Pure Dog Talk to disclose that information to other authenticated Members within the Member Area. We do not control how other Members may use, save, or share information they view in the directory. We expect Members to use the directory for the legitimate purposes described in our Terms of Service and prohibit the misuse of Member directory data, including data scraping, harvesting, or mass-extraction. Violations may result in Account suspension or termination.

Tier-Based Access

The directory and certain Member features may be available to all Members regardless of tier or may be restricted to specific tiers. Where access is restricted by tier, only authenticated Members of the applicable tier may view the relevant Member data. We reserve the right to modify tier-based access in our sole discretion, with notice as appropriate.

Member-to-Member Communications

Where the Services offer Member-to-Member messaging or community posting features, the content of such communications is visible to the recipient(s) and to Pure Dog Talk for moderation, abuse prevention, and legal compliance purposes. Communications are retained in accordance with Section 12. Where one party to a Member-to-Member communication terminates their Account, the communication may continue to be visible to the remaining party except where deletion is technically practicable and legally required.

Profile Deletion

You may delete your directory profile information without deleting your Account. You may also fully delete your Account, in which case your directory profile information will also be removed, subject to the retention provisions in Section 12.

Disclosure of Personal Information

We may disclose Personal Information to the following categories of recipients:

  1. Other authenticated Members, with respect to information you have voluntarily submitted to your Member directory profile or to community features (as described in Section 7);
  2. Service Providers who Process Personal Information on our behalf, including without limitation our payment processor, membership platform, email service provider, hosting provider, analytics provider, scheduling provider, and filming partner (as described in Section 10);
  3. Affiliates and subsidiaries of Pure Dog Talk that are bound by privacy obligations consistent with this Policy;
  4. Legal authorities, when we believe in good faith that disclosure is required by law, legal process, or government request, or is necessary to protect the rights, property, or safety of Pure Dog Talk, our Users, or others;
  5. A successor entity in connection with any merger, acquisition, sale of assets, financing, reorganization, bankruptcy, or similar transaction. Where reasonably practicable, we shall provide notice to affected Users prior to such transfer;
  6. Other parties with your consent or at your direction.

We do not sell or rent Personal Information to third parties for monetary consideration.

Sale and Sharing of Personal Information (California)

No Sale for Monetary Consideration

Pure Dog Talk does not "sell" Personal Information for monetary consideration as the term "sale" is defined under the California Consumer Privacy Act and California Privacy Rights Act.

Sharing for Cross-Context Behavioral Advertising

To the extent that third-party analytics services (such as Google Analytics) deploy cookies or similar technologies on the Services that may constitute "Sharing" for cross-context behavioral advertising under the CPRA, California residents have the right to opt out of such Sharing. You may exercise this right by:

  1. Adjusting your browser cookie settings to block third-party cookies;
  2. Using opt-out tools provided by analytics services (e.g., the Google Analytics opt-out browser add-on at tools.google.com/dlpage/gaoptout);
  3. Enabling the Global Privacy Control ("GPC") signal in your browser, which we treat as a valid opt-out request;
  4. Contacting us at team@puredogtalk.com with the subject line "Do Not Share."

Minors Under 16

We do not have actual knowledge that we sell or share the Personal Information of consumers under the age of sixteen (16). We do not Sell or Share the Personal Information of consumers we know to be under sixteen (16) years of age without affirmative opt-in consent (from the consumer if 13 to 16, or from a parent or legal guardian if under 13).

Third-Party Service Providers

We engage the following Service Providers to assist in operating the Services. Each Service Provider is bound by a written contract that prohibits the Service Provider from selling, sharing, retaining, using, or disclosing the Personal Information for any purpose other than the specific business purpose for which it is provided, and from combining the Personal Information with Personal Information received from other sources except as expressly permitted by applicable law:

  • Stripe, Inc. — payment processing. Processes payment card information, billing details, and transaction records. Stripe maintains its own privacy and security commitments, including PCI-DSS compliance. See stripe.com/privacy.
  • MemberPress (Caseproof, LLC) — membership management platform. Processes Account registration, login credentials, Subscription status, and access controls for the Member Area. See memberpress.com/privacy-policy.
  • Mailchimp (Intuit, Inc.) — email marketing platform. Processes email addresses, names, engagement metrics (open rates, click-throughs), unsubscribe events, and subscription preferences. We use Mailchimp's double opt-in feature for newsletter subscribers in the European Economic Area, the United Kingdom, and other jurisdictions requiring opt-in consent. See intuit.com/privacy.
  • Google LLC (Google Analytics) — website analytics services. Processes website usage data, device and browser information, and aggregate user behavior. We use Google Analytics 4, which does not store IP addresses; instead, IP addresses are used solely for general geographic location derivation and discarded. We have entered into a Data Processing Amendment with Google for compliance with applicable data protection law. See policies.google.com/privacy and Google Analytics privacy practices.
  • Calendly, LLC — appointment scheduling platform. Processes name, email address, time zone, scheduled meeting details, and any information you voluntarily provide when booking a consultation through the Services. See calendly.com/privacy.
  • Spotify USA Inc., Apple Inc., and other podcast distribution platforms — podcast hosting and distribution. Process podcast subscription and listening data on their platforms in accordance with their respective privacy policies.
  • DOGG!T — Seminar filming and video production partner. Processes audio, video, and photographic recordings of Seminars, including attendee likenesses. DOGG!T may store and distribute filmed content on its own platforms in accordance with its own privacy policies and the licenses granted under our Terms of Service.
  • Web hosting providers, content delivery networks, and security services — operate the technical infrastructure of the Services.

This list may be updated from time to time. Material additions of new categories of Service Providers will be reflected in a revised version of this Policy.

International Data Transfers

Pure Dog Talk is based in the United States, and our Service Providers may be located in the United States or other jurisdictions. If you access the Services from outside the United States, your Personal Information will be transferred to, stored, and Processed in the United States and other jurisdictions in which our Service Providers operate.

For Personal Information transferred from the European Economic Area, the United Kingdom, or Switzerland to the United States or other jurisdictions that have not been determined by the European Commission, the UK Information Commissioner's Office, or the Swiss Federal Data Protection and Information Commissioner to provide an adequate level of data protection, we rely on appropriate transfer mechanisms, including without limitation the European Commission's Standard Contractual Clauses (Module 2 or Module 3 as applicable), the UK International Data Transfer Addendum, the Swiss-equivalent transfer mechanisms, or other lawful transfer safeguards.

Data Retention

We retain Personal Information for the period necessary to fulfill the purposes for which it was collected, unless a longer retention period is required by law. Specific retention periods are as follows:

  • Active Account information: Retained for the duration of your active Account relationship.
  • Inactive Free Accounts: May be deleted after twenty-four (24) consecutive months of inactivity, with reasonable advance notice where practicable.
  • Member directory profile data: Retained for the duration of your active Account; deleted upon Account or profile deletion subject to the exceptions below.
  • Course progress and digital badge records: Retained for the duration of your Account; certificate and badge issuance records may be retained beyond Account deletion to preserve the integrity of issued credentials.
  • Community posts, comments, and messages: Retained for the duration of your Account. Upon Account deletion, posts may be anonymized or pseudonymized rather than fully deleted in order to preserve the integrity of community discussions, except where full deletion is required by applicable law.
  • Financial and transaction records: Retained for at least seven (7) years from the date of transaction to comply with tax, accounting, and audit obligations.
  • Marketing data and email subscription records: Retained until you unsubscribe or request deletion, plus a reasonable cleanup period of up to thirty (30) days.
  • Calendly booking records: Retained for the duration of the booking lifecycle and for a reasonable period thereafter for record-keeping and follow-up purposes.
  • Seminar and event records: Retained for the duration of the event lifecycle and for a reasonable period thereafter to address inquiries, disputes, or legal obligations.
  • Podcast guest information and recordings: Retained indefinitely as part of our archival programming, subject to the licenses granted to us in our Terms of Service.
  • Information subject to a legal hold or active dispute: Retained until the matter is resolved.

When Personal Information is no longer required, we will securely delete, destroy, de-identify, or anonymize it in accordance with our internal retention schedule and applicable law. De-identified or anonymized information may be retained indefinitely for analytics and statistical purposes, provided it cannot reasonably be re-identified.

Information Security

We implement and maintain reasonable administrative, physical, and technical safeguards designed to protect Personal Information against accidental, unlawful, or unauthorized destruction, loss, alteration, disclosure, or access. Such measures include encrypted transmission of payment information using industry-standard encryption protocols (TLS 1.2 or higher), encryption of sensitive data at rest using AES-256 or comparable standards where reasonably feasible, password-protected access to the Member Area, multi-factor authentication for administrative accounts, access controls limiting Personal Information to personnel with a legitimate business need, and secure storage environments.

Member Responsibility

Members are responsible for maintaining the confidentiality of their Account credentials and for all activity occurring under their Account. You agree to notify us immediately at team@puredogtalk.com of any unauthorized use of your Account or any other security breach of which you become aware.

No Guarantee of Absolute Security

No method of transmission over the internet or method of electronic storage is one hundred percent secure. While we strive to protect your Personal Information using commercially reasonable measures, we cannot and do not guarantee absolute security, and your use of the Services is at your own risk.

Data Breach Notification

In the event of a data breach affecting your Personal Information, we will provide notice in accordance with applicable law. For Data Subjects in the European Economic Area or United Kingdom, where the breach is likely to result in a risk to the rights and freedoms of natural persons, we shall notify the competent supervisory authority without undue delay and, where feasible, not later than seventy-two (72) hours after becoming aware of the breach, in compliance with Article 33 of the GDPR. Where the breach is likely to result in a high risk, we shall communicate the breach to affected Data Subjects without undue delay in compliance with Article 34 of the GDPR.

For U.S. residents, we shall provide notice in the most expedient time possible and without unreasonable delay, consistent with the legitimate needs of law enforcement and any measures necessary to determine the scope of the breach and restore the integrity of the affected systems, in compliance with applicable state breach notification laws.

Your Privacy Rights

Subject to applicable law and verification of your identity, you have the following rights with respect to your Personal Information:

Right to Know / Right of Access

You may request that we disclose the categories and specific pieces of Personal Information we have collected about you, the categories of sources, the business or commercial purposes for collection, and the categories of third parties with whom we have shared the information.

Right to Correct / Rectification

You may request that we correct inaccurate Personal Information that we maintain about you and complete incomplete Personal Information.

Right to Delete / Erasure

You may request that we delete Personal Information we have collected about you, subject to legal exceptions including without limitation our need to: (a) complete the transaction for which the Personal Information was collected; (b) detect security incidents or fraud; (c) comply with a legal obligation; (d) maintain financial or transaction records; or (e) defend legal claims.

Right to Restrict Processing

Where required by applicable law (including GDPR Article 18), you may request that we restrict the Processing of your Personal Information in certain circumstances, such as when you contest the accuracy of the data, when Processing is unlawful but you object to deletion, when we no longer need the data but you require it for legal claims, or when you have objected to Processing pending verification of legitimate grounds.

Right to Data Portability

Where required by applicable law, you may request a copy of your Personal Information in a structured, commonly used, and machine-readable format (such as CSV or JSON), and to have such data transmitted to another controller where technically feasible.

Right to Opt Out of Sale or Sharing

California residents have the right to opt out of the "Sale" or "Sharing" of Personal Information as those terms are defined under the CCPA and CPRA. As described in Section 9, we do not sell Personal Information for monetary consideration. To opt out of cross-context behavioral advertising sharing, see Section 9.

Right to Limit Use of Sensitive Personal Information

California residents may request that we limit the use of Sensitive Personal Information to specific purposes. We do not currently use Sensitive Personal Information for purposes that would trigger this right.

Right to Withdraw Consent

Where Processing is based on your consent, you may withdraw consent at any time. Withdrawal of consent does not affect the lawfulness of Processing based on consent before its withdrawal. Withdrawal of consent may be exercised through the same mechanism by which consent was given (for example, by toggling a setting in your dashboard or unchecking a marketing preference) or by contacting us as set forth in Section 15.

Right to Object

You have the right to object to the Processing of your Personal Information for direct marketing purposes at any time, and we shall cease such Processing upon receipt of your objection. Where required by applicable law, you may also object to Processing based on legitimate interests, in which case we shall cease such Processing unless we demonstrate compelling legitimate grounds that override your interests, rights, and freedoms, or where the Processing is necessary for the establishment, exercise, or defense of legal claims.

Right to Lodge a Complaint

If you are located in the European Economic Area, the United Kingdom, or another jurisdiction with a privacy supervisory authority, you have the right to lodge a complaint with such authority regarding our Processing of your Personal Information.

Right Not to Be Subject to Automated Decision-Making

You have the right not to be subject to a decision based solely on automated Processing, including profiling, that produces legal effects concerning you or similarly significantly affects you. As stated in Section 6, we do not engage in such automated decision-making.

Right to Non-Discrimination

We will not discriminate against you for exercising any of your privacy rights. Specifically, we will not deny goods or services, charge different prices, or provide a different level or quality of service because you exercised your rights.

Right to Designate an Authorized Agent

California residents may designate an authorized agent to make a request on their behalf, in compliance with California Civil Code §1798.130 and 10 CCR §7062. We shall require the authorized agent to provide signed written permission from the consumer, and we may require the consumer to verify their identity directly with us or directly confirm with us that they have provided the authorized agent permission to submit the request, except for requests submitted by a power of attorney established under California Probate Code §§4000 to 4465.

How to Exercise Your Rights

To exercise any of the rights described in Section 14, please submit a request by:

  1. Sending an email to team@puredogtalk.com with the subject line "Privacy Request"; or
  2. Updating your information directly through your account dashboard at puredogtalk.com/account/, where applicable; or
  3. Sending written correspondence to the postal address set forth in Section 25.

Verification

To protect your Personal Information, we will take reasonable steps to verify your identity before fulfilling your request. The verification method will depend on the nature of the request and the sensitivity of the Personal Information involved. For requests requiring a low degree of certainty, we may match two data points provided by you with data we maintain. For requests requiring a higher degree of certainty (such as deletion of sensitive data), we may match three data points and obtain a signed declaration under penalty of perjury. We will not require you to create a new Account in order to make a request.

Response Time

We will respond to verifiable requests within forty-five (45) days of receipt for California residents, or within thirty (30) days for residents of jurisdictions subject to the GDPR or comparable laws. We may extend the response period by an additional forty-five (45) days where reasonably necessary, with notice to you of the extension and the reasons for the delay.

No Fee

We will not charge a fee to respond to verifiable requests, unless your request is manifestly unfounded, excessive, or repetitive, in which case we may charge a reasonable fee or decline to act on the request, as permitted by applicable law. The fee, if any, shall be based on the administrative costs of providing the requested information or taking the requested action.

Format of Response

Where you request a copy of your Personal Information, we shall provide the response in a structured, commonly used, and machine-readable format such as CSV or JSON, or in another format that is reasonably accessible to you.

Children's Privacy

The Services are not directed to children under the age of thirteen (13). Pure Dog Talk does not knowingly collect, use, or disclose Personal Information from children under 13 in violation of the Children's Online Privacy Protection Act ("COPPA"), 15 U.S.C. § 6501 et seq.

If a parent or legal guardian becomes aware that a child under 13 has provided Personal Information to Pure Dog Talk, the parent or guardian may contact us at team@puredogtalk.com to:

  1. Request review of the Personal Information we have collected;
  2. Request deletion of such Personal Information;
  3. Refuse to permit further collection or use of such Personal Information.

We will take prompt steps to delete any such Personal Information upon receipt of a verified request. For Users between the ages of 13 and 17, registration is permitted only with verifiable parental or legal guardian consent.

For Users between the ages of 13 and 16, in compliance with the CCPA and CPRA, we shall not Sell or Share their Personal Information without affirmative opt-in consent from the User. For Users under 13, parental opt-in consent is required.

Essential to the operation of the Services, including authentication, session management, paywall enforcement, and security. These cannot be disabled without affecting functionality and do not require consent under applicable law.

Analytics Cookies

Help us understand how Members and visitors use the Services, including pages viewed and time spent on the site. We use Google Analytics 4 for this purpose, which sets cookies such as _ga and _ga_[CONTAINER_ID] to distinguish unique users and sessions. Where required by applicable law (including in the European Economic Area and United Kingdom), analytics cookies are deployed only after obtaining your affirmative opt-in consent through our cookie consent mechanism.

Cookie Management

You may adjust your browser settings to refuse cookies, delete existing cookies, or be notified when cookies are set. You may also use our cookie consent management tools where provided. Refusing or deleting cookies may affect the functionality of certain features and may interfere with Member Area authentication. Do Not Track Signals

Some browsers transmit "Do Not Track" ("DNT") signals to websites. As there is currently no industry consensus on how to interpret DNT signals, we do not currently respond to DNT signals. We will update this Policy if our practice changes.

Global Privacy Control

We treat the Global Privacy Control ("GPC") browser signal as a valid request to opt out of the Sale or Sharing of Personal Information for cross-context behavioral advertising under the CPRA.

Email Communications

If you subscribe to our newsletter, your email address and any associated information you provide is maintained on our email marketing platform (Mailchimp). For Users in the European Economic Area, the United Kingdom, and other jurisdictions requiring opt-in consent for marketing communications, newsletter subscription is conducted through Mailchimp's double opt-in process, requiring confirmation of subscription via email before any marketing communications are sent.

We send periodic newsletters, including episode updates, event announcements, and program news. You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any marketing email or by contacting us at team@puredogtalk.com.

Members who register for free or paid Accounts will receive transactional emails related to their Account, including welcome emails, renewal reminders, and payment receipts. These emails are necessary for Account management and cannot be opted out of while your Account remains active.

All marketing communications comply with the CAN-SPAM Act of 2003 (15 U.S.C. § 7701 et seq.) and, where applicable, the GDPR's e-privacy requirements.

Audio, Video, and Photographic Recording

Certain Services involve audio, video, or photographic recording, including without limitation podcast guest appearances and Seminar filming by Pure Dog Talk and our partners (including DOGG!T).

Podcast Guest Appearances

Podcast guests grant Pure Dog Talk a perpetual license to use their voice, image, and likeness as set forth in our Terms of Service. Recordings are retained indefinitely as part of our archival programming. Guest contact information is retained for ongoing communication and is subject to your privacy rights as set forth in Section 14.

Seminar Filming

Some Seminars include filming by DOGG!T or other partners. Attendees provide consent to filming as part of Seminar registration and are notified at the event. Attendees who do not wish to be filmed must notify staff prior to the start of filming.

User-Submitted Photographs and Videos

If you submit photographs or videos as part of testimonial submissions, Member directory profiles, Club Partner submissions, or other Services, you represent that you have authority to do so and that any individuals depicted (including any minors) have provided necessary consent. Submitted photographs may contain embedded metadata (such as EXIF data including location, device, and timestamp), which Pure Dog Talk may strip, retain, or display in accordance with our internal practices.

Biometric Considerations

Pure Dog Talk does not use voice or facial recognition technologies, automated biometric identification, or similar processes on User recordings. Recordings are used solely for the editorial and promotional purposes set forth in our Terms of Service. To the extent any voice, facial, or other biological characteristics could be characterized as "biometric information" under state laws such as the Illinois Biometric Information Privacy Act (740 ILCS 14/1 et seq.), Pure Dog Talk does not collect, capture, purchase, receive, or otherwise obtain such biometric identifiers or biometric information for biometric purposes.

State-Specific Notices

California (CCPA / CPRA)

This Section, together with Sections 3, 4, 8, 9, 14, and 15, satisfies the disclosure requirements of the California Consumer Privacy Act and California Privacy Rights Act. California residents may also request the disclosure described under California Civil Code §1798.83 (the "Shine the Light" law) regarding our disclosure of certain Personal Information to third parties for direct marketing purposes by contacting us at team@puredogtalk.com. We do not disclose Personal Information to third parties for their direct marketing purposes.

Virginia (VCDPA)

Virginia residents have rights under the Virginia Consumer Data Protection Act, including the rights described in Section 14. To appeal a decision regarding your privacy rights request, you may contact us at team@puredogtalk.com with the subject line "Privacy Appeal." We shall respond to appeals within sixty (60) days. If we deny your appeal, you may contact the Virginia Attorney General to submit a complaint.

Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), and Other States

Residents of Colorado, Connecticut, Utah, Texas, and other states with comprehensive privacy laws have rights under those statutes substantially similar to those described in Section 14. We honor such rights in accordance with applicable law.

Nevada

Nevada residents have the right to opt out of the sale of certain Personal Information under Nevada Revised Statutes §603A.340. Pure Dog Talk does not currently sell Personal Information as defined under Nevada law. To submit a verified request to opt out, contact us at team@puredogtalk.com.

European Economic Area, United Kingdom, and Switzerland

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have rights under the EU General Data Protection Regulation (Regulation (EU) 2016/679), the UK GDPR, and the Swiss Federal Act on Data Protection. These rights are described in Section 14.

EU and UK Representatives

Pure Dog Talk does not currently meet the thresholds requiring designation of an EU Representative under GDPR Article 27 or a UK Representative under UK GDPR Article 27. If we become subject to such requirements, we shall update this Policy to identify our Representative.

Legal Bases for Processing

The legal bases on which we Process your Personal Information are described in Section 6 in connection with each purpose of Processing.

Right to Lodge a Complaint

You have the right to lodge a complaint with the supervisory authority in your jurisdiction regarding our Processing of your Personal Information. A list of EU supervisory authorities is available at edpb.europa.eu. The UK supervisory authority is the Information Commissioner's Office, available at ico.org.uk.

Automated Decision-Making

Pure Dog Talk does not make decisions based solely on automated Processing, including profiling, that produce legal effects concerning you or similarly significantly affect you.

Pure Dog Talk does not provide veterinary, medical, or health-related services to humans. Our Content may discuss canine health, breeding, and care for educational purposes only. To the extent any User voluntarily discloses information about their own or another individual's health condition through the Services, such disclosure is voluntary and is not subject to the protections of the Health Insurance Portability and Accountability Act ("HIPAA") or similar laws governing protected health information. We are not a "covered entity" or "business associate" as defined under HIPAA.

The Services may contain links to third-party websites, applications, or services. This Policy does not apply to information collected by such third parties, and Pure Dog Talk is not responsible for the privacy practices of third parties. We encourage you to review the privacy policies of any third-party website, application, or service you visit.

Changes to This Policy

Pure Dog Talk may modify this Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will notify Users of material changes by:

  1. Posting an updated effective date at the top of this Policy;
  2. Sending an email to the address associated with your Account, where one exists, in the case of material changes;
  3. Where appropriate, displaying a notice on our website for at least fourteen (14) days before the change takes effect.

Your continued use of the Services following the effective date of any change shall constitute your acceptance of the modified Policy. If you do not agree to a modification, your sole remedy is to terminate your Account before the effective date of the change.

The Effective Date set forth at the top of this Policy reflects the date the current version became effective. Personal Information collected prior to the Effective Date shall continue to be governed by the version of this Policy in effect at the time of collection, except where applicable law requires retroactive application of new privacy practices.
